Biography
Brad McCamy has 15 years of experience preparing title opinions. He has examined lands with various attributes and considerations, from state, federal, and Indian ownership to lands affected by townsites, railroads, water bodies, and production-related issues. He has prepared title opinions predominantly in North Dakota, but also has experience in Montana, Colorado, and Texas. His title opinions include original, supplemental, and division order title opinions for mineral rights involving navigable bodies of water, overlapping spacing units, and private, state, federal, and tribal ownerships. He also has experience preparing acquisition, lending, and surface title opinions.
Brad’s experience encompasses other aspects of natural resources law. He is well-versed in handling complex legal matters involving operational issues, lease validity and maintenance, royalty payments, disputes of title, and renewable energy projects. His experience includes advising on wind land leases and solar agreements, and he has experience conducting title examinations related to a major carbon sequestration facility. He has counseled clients concerning the treatment of federal and state oil and gas leases covering navigable waterways in North Dakota and Montana. He also prepares various curative instruments, such as corrective conveyances, lease assignments, rights-of-way, affidavits of heirship, corporation successions, and stipulations and cross-conveyances of interest.
Brad’s practice also extends to trust and estate issues, including assisting clients with probate matters. Additionally, he has advised clients on the purchase of Native American trust lands administered by the Bureau of Indian Affairs, the process of trust-to-fee conversion, and the probate procedures required before such interests become eligible for purchase.
Brad’s practice also includes various corporate matters. He has worked on several due diligence projects, which have included title review, identifying and assisting with defect curative, reviewing purchase and sale agreements, and providing mortgage opinions.
Brad takes pride in finding answers to novel issues and unanswered questions. Proposing strategic solutions to address client needs and helping clients move forward with their goals is his objective.
