SMS Terms of Service

These SMS Terms of Service (“SMS Terms”) govern your participation in the text messaging program operated by Oliva Gibbs PLLC (“Oliva Gibbs,” “the Firm,” “we,” “our,” or “us”). By opting in to receive SMS messages from us, you agree to these SMS Terms.

Program description

Oliva Gibbs uses SMS/text messaging to communicate with individuals who have contacted the Firm regarding an employment application or other requested correspondence. Messages may include:

• Appointment confirmations and reminders;
• Intake follow-ups;
• Communications regarding potential employment with Oliva Gibbs;
• Requests for documents or information; and/or
• Administrative case-related updates.

We do not send promotional or marketing text messages.

Opt-in consent

You may opt in to receive SMS messages by:

• Submitting your phone number through our website with express consent;
• Providing written consent during intake;
• Providing verbal consent; or
• Initiating text communication with our office.

By opting in, you confirm:

• You are the authorized user of the mobile number provided;
• You consent to receive text messages related to your inquiry or application; and
• Your consent is not a condition of obtaining legal services or employment with Oliva Gibbs.

Message frequency

Message frequency varies depending on your interaction with the Firm and the status of your inquiry or matter.

Fees and charges

Message and data rates may apply for any messages sent to you from us and to us from you. Please contact your wireless provider for information about your messaging or data plan. Wireless carriers are not liable for delayed or undelivered messages.

Opt-out

You may opt out of receiving SMS messages by replying “STOP” or “QUIT” at any time. After you send “STOP” or “QUIT”:

• You will receive a confirmation message; and
• You will no longer receive SMS message from us unless you re-enroll.

To opt back in, you may reply “START” or contact our office directly.

Modifications

We reserve the right to modify these SMS Terms at any time. Updated terms will be posted with a revised effective date. Your continued participation in the SMS program constitutes acceptance of any changes.

Governing law

These SMS Terms are governed by the laws of the State of Texas. Any disputes arising under these SMS Terms shall be resolved in accordance with the dispute resolution provisions set forth in our Website Terms of Service.
